Terms of Service
The terms and conditions governing HVAC services provided by Air Control Inc. in Ontario, Canada.

Please read these Terms of Service carefully before engaging Air Control Inc. for any HVAC service. These terms establish the rights and responsibilities of both parties and form part of our service agreement with you. If you have any questions before work begins, please contact us — we are happy to clarify.
Service Agreements
These Terms of Service ("Terms") govern all HVAC services provided by Air Control Inc. ("Company", "we", "us") to customers ("Client", "you"). By accepting a quote, booking a service, or allowing our technicians to perform work at your property, you agree to these Terms.
All work is performed pursuant to a service agreement, which may take the form of a written proposal, quote, work order, or invoice. The scope of work, pricing, and any special conditions are set out in that agreement. In the event of any conflict between a specific service agreement and these Terms, the service agreement prevails.
Air Control Inc. reserves the right to decline or discontinue services at its sole discretion.
Payment Terms
Payment for all services is due upon completion of work, unless otherwise agreed in writing prior to commencement. For large installations or multi-phase projects, payment milestones may be established in the service agreement.
Accepted payment methods include credit card (processed via Stripe), electronic funds transfer (EFT), cheque, and cash. A deposit may be required before scheduling certain services — see our Refund & Cancellation Policy for details.
Invoices not paid within 30 days of the due date may be subject to a late payment charge of 2% per month (24% per annum) on the outstanding balance, or the maximum rate permitted by Ontario law, whichever is lower.
In the event of non-payment, Air Control Inc. reserves the right to pursue collection through all legally available means, including but not limited to placing a lien on the property under the Construction Act (Ontario).
Warranty on Workmanship
Air Control Inc. warrants that all labour and workmanship performed will be free from defects for a period of 90 days from the date of service completion, unless a longer period is stated in writing in the service agreement.
Equipment and parts are covered by the applicable manufacturer's warranty. Air Control Inc. will assist with warranty claims but is not responsible for manufacturer warranty terms, which are set by the original equipment manufacturer (OEM).
Warranty coverage is voided if: (a) equipment or work is tampered with or modified by a third party; (b) the issue results from misuse, neglect, or failure to follow maintenance recommendations; (c) damage is caused by circumstances beyond our control, including power surges, flooding, fire, or acts of nature; or (d) regular maintenance required to maintain equipment performance has not been performed.
Limitation of Liability
Air Control Inc. carries commercial general liability insurance and WSIB coverage. In the event of damage or loss caused by our negligence, our liability is limited to the direct cost of remedying the defect or, at our option, re-performing the affected portion of the service.
We are not liable for any indirect, incidental, consequential, or special damages arising from our services, including but not limited to: loss of revenue, loss of use of equipment, business interruption, or costs arising from delays beyond our control.
Our total aggregate liability for any claim arising from a specific service engagement shall not exceed the total amount paid by the Client for that engagement.
Nothing in these Terms limits liability for personal injury or death caused by our negligence, or for fraud or fraudulent misrepresentation.
Customer Responsibilities
To allow Air Control Inc. to perform work safely and effectively, you agree to:
- Provide safe and unobstructed access to the work area, including rooftop areas, mechanical rooms, and equipment locations, at the agreed appointment time
- Ensure that any required permits, building management approvals, or landlord/strata authorizations have been obtained prior to our technicians arriving on-site
- Notify us in advance of any known hazards on the property (e.g., asbestos, restricted access areas, security requirements)
- Ensure that a responsible adult (18+) is present at the property for residential service calls
- Keep pets and children away from work areas during service
- Inform us of any pre-existing damage or known issues with equipment or systems prior to service
Failure to meet access or notification requirements may result in a reschedule fee or cancellation charge. We are not responsible for delays or additional costs arising from conditions not disclosed prior to our arrival.
Estimates & Intellectual Property
All quotes, proposals, drawings, and technical specifications prepared by Air Control Inc. are the intellectual property of Air Control Inc. and are provided for the Client's use in evaluating our services only. They may not be shared with or used by competing contractors without our express written consent.
Governing Law
These Terms, and any disputes arising from or related to our services, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Any disputes that cannot be resolved through good-faith discussion shall be submitted to the exclusive jurisdiction of the courts of Ontario, sitting in the City of Brampton or the City of Toronto, as determined by Air Control Inc.
Air Control Inc. and the Client agree to attempt to resolve any dispute informally before initiating formal legal proceedings.
Changes to These Terms
Air Control Inc. may update these Terms from time to time. The most current version will be posted on our website. Continued use of our services after any update constitutes your acceptance of the revised Terms.
For services already underway at the time of a revision, the Terms in effect at the date of the original service agreement will continue to apply unless otherwise agreed in writing.
Jurisdiction
These Terms are governed by the laws of Ontario, Canada. Air Control Inc. is a licensed HVAC contractor operating from Brampton, Ontario, and serving clients throughout the GTA and the Province of Ontario.
